The ACLU of Florida has filed a lawsuit against the state’s Agency for Health Care Administration (AHCA) for allegedly using taxpayer funds to promote misinformation about Amendment 4, a constitutional amendment on Florida’s November ballot that would protect abortion rights. The lawsuit, filed on behalf of Floridians Protecting Freedom, Inc., challenges AHCA’s website and TV ads claiming the amendment threatens women’s safety. Amendment 4, if passed by 60% of voters, would legalize abortions until fetal viability.
The ACLU argues that the AHCA’s campaign, which defends Florida’s six-week abortion ban, unlawfully uses state resources to influence voters. AHCA Secretary Jason Weida defended the messaging as factual and non-political, while Governor Ron DeSantis supported the agency’s efforts.
The lawsuit aims to halt the state’s campaign and protect voters’ rights in the upcoming election.
