The Arizona House blocked a vote to repeal the Civil War-era abortion ban, marking the second such instance. Governor Katie Hobbs expressed her commitment to protect Arizonan freedoms and ensure women’s access to care, following the failed vote.

The Arizona Supreme Court upheld the abortion ban on April 9, stating that the legislature has never authorized elective abortion. The ruling, which makes most abortions illegal, supersedes a 15-week abortion ban passed in 2022. The law from 1864, banning nearly all abortions, remains in effect after the overturning of the constitutional right to an abortion.

Efforts to revive the Civil War-era legislation faced opposition from abortion-rights advocates, including Planned Parenthood Arizona.
