At the time of this writing, 22 states have filed a lawsuit challenging President Donald Trump’s executive order to revoke U.S. citizenship for some babies born in the U.S. The Democratic-led states argue the order violates the 14th Amendment, which guarantees citizenship to all born in the U.S.
Trump’s executive order claims the amendment has been misinterpreted, stating, “The Fourteenth Amendment has never been interpreted to extend citizenship universally.” Attorneys general opposing the order argue the president lacks authority to alter constitutional provisions.
The lawsuit cites Pew Research data showing 4.4 million U.S.-born children live with unauthorized immigrant parents, with 11 million unauthorized immigrants residing in the U.S. The executive order, set to take effect February 19, 2025, would not affect children born before that date.
