The Wisconsin Supreme Court ruled Tuesday that the Republican-controlled Legislature cannot block administrative rules like the state’s ban on conversion therapy, granting Gov. Tony Evers greater authority over rulemaking.
The 4–3 ruling, issued by the court’s liberal majority, declared that the Legislature’s Joint Committee for the Review of Administrative Rules overstepped its authority by blocking a professional licensing board’s move to classify conversion therapy as unprofessional conduct. The court said such legislative action violates the state constitution, which requires laws to pass both chambers and be presented to the governor.
Evers called the decision “incredibly important,” while GOP Sen. Steve Nass warned it gives the governor “unchecked dominion.”
The ruling affects more than LGBTQ+ issues. It could shift control over environmental regulations, public health rules, and vaccine policies long stymied by legislative objections. The U.S. Supreme Court is also set to weigh in on conversion therapy bans in a pending case from Colorado.
