SAN DIEGO, California — A federal judge has ordered the California Department of Education and Attorney General Rob Bonta to appear in court to explain why they should not face sanctions for allegedly misleading the court over school policies related to student gender identity and parental notification.
U.S. District Judge Roger Benitez issued the order in Mirabelli v. Olson, a class-action lawsuit representing California parents and teachers who oppose what they call “Parental Exclusion Policies.” These district-level rules require educators to use students’ preferred names and pronouns at school while withholding that information from parents.
The Thomas More Society, representing the plaintiffs, alleges the state falsely told the court it had withdrawn such policies, while simultaneously mandating PRISM training—a state-run online program promoting LGBTQ+ student support. Attorneys for the group accused the state of “an egregious attempt to mislead the Court.”
Peter Breen, the group’s head of litigation, said officials “have been caught attempting to mislead the Court to escape accountability.” The court has scheduled the next summary judgment hearing for November 17, when the issue will be reviewed further.
The California Department of Education and Bonta’s office have not commented on the ruling.
