Rep. Jamie Raskin (D-Md.) has called for Supreme Court Justice Clarence Thomas to recuse himself from any future rulings related to former President Donald Trump’s eligibility for the 2024 presidential ballot under the 14th Amendment. Speaking on CNN’s “State of the Union,” Raskin highlighted the involvement of Thomas’s wife in promoting the “big lie” about the 2020 election and her activities leading up to the January 6 events. Raskin believes that these factors should preclude Thomas from participating in such cases.
This suggestion comes in the wake of Maine’s Secretary of State deciding to remove Trump from the state’s ballot, citing his ineligibility under Section 3 of the 14th Amendment. Maine is the second state, following Colorado, to make such a determination. Colorado’s Supreme Court earlier barred Trump from appearing on the state’s ballot, a decision expected to face challenges from Trump.
Both state decisions, along with challenges in other states, seem poised to culminate in a Supreme Court deliberation. Raskin contends that Trump has effectively disqualified himself from the ballot. He argues that overturning the Maine and Colorado rulings would mean the justices are succumbing to an undemocratic argument, placing Trump in a rare category of individuals deemed ineligible for election.
