Former White House ethics lawyer Jim Schultz, who served under the Trump administration, forecasted a rapid dismissal of former President Donald Trump’s claim for immunity regarding multiple federal indictments. The Supreme Court, on December 22, declined to address Trump’s potential prosecution for his actions related to the 2020 election overturn attempt. This decision led to the case moving to the District of Columbia Circuit Court. Schultz referred to this court as a precursor to the Supreme Court, noting its significance.
In a CNN interview, Schultz expressed confidence that the D.C. Circuit Court would swiftly reject Trump’s immunity claim. Trump’s legal team had argued for his immunity, citing actions taken during his presidency, including the January 6, 2021, Capitol riot. However, this claim was previously dismissed by the initial judge in the case.
Justice Department special counsel Jack Smith, opposing Trump’s immunity plea, asserted that a former president could be subject to investigation, indictment, trial, and punishment for actions taken during their presidency. He emphasized that a former president could face federal criminal prosecution like any other citizen. This stance challenges Trump’s appeal to the D.C. Circuit Court and underscores the potential for his immunity claim to be rapidly overturned.
