Eighteen California children are suing the Environmental Protection Agency (EPA), alleging it failed to protect them from climate change, infringing on their constitutional rights. The lawsuit, Genesis B. v. United States Environmental Protection Agency, is led by 17-year-old Genesis B. from Long Beach, who struggles with extreme heat without air conditioning.

The plaintiffs, aged 8 to 17, share experiences of climate change impacts, including wildfires and floods. They argue that the EPA has neglected its duty to address carbon dioxide emissions, recognized as a public health threat since 2009. The lawsuit, filed by Our Children’s Trust, follows a similar successful case in Montana.

The EPA, limited by ongoing litigation, has not commented. The suit seeks no financial compensation but demands acknowledgment of children’s environmental rights and the EPA’s responsibility. Our Children’s Trust is also involved in other climate-related legal actions nationwide.
