Texas Attorney General Ken Paxton has declared that doctors performing abortions in Texas will be prosecuted, even in cases where a court grants an exception. This follows a ruling in Austin allowing an abortion for a woman with a fetus diagnosed with a lethal condition.

Paxton emphasized that neither hospitals nor doctors are exempt from civil and criminal liabilities under Texas’ strict abortion laws. The temporary restraining order (TRO) granted by District Judge Maya Guerra Gamble, which protects Kate Cox, her husband, and her physician, does not prevent potential future prosecutions.

Texas’ abortion law, one of the nation’s strictest, allows medical exceptions to save the mother’s life but is vague on defining such risks. Paxton’s stance extends to threatening legal action against hospitals and staff involved in abortion procedures.

Former Rep. Beto O’Rourke criticized Paxton’s response, highlighting the severe implications for women denied abortions even in medically critical and court-sanctioned circumstances.
