The Tennessee Senate has passed a bill requiring businesses to post a notice if they allow transgender people to use bathrooms that correspond to their gender identity. The notice would have to be placed at the entrance of the restroom. It would read, “This facility maintains a policy of allowing the use of restrooms by either biological sex, regardless of the designation on the restroom.”

The bill would also require the Tennessee Department of Health to issue birth certificates that only list a person’s sex at birth, not gender identity. Critics argue that the bill is discriminatory and could further marginalize transgender individuals. The measure now goes to the state’s House of Representatives for consideration. If it becomes law, Tennessee risks losing federal funding due to potential violations of Title VII, which prohibits sex discrimination in employment.
